A prenuptial agreement is a contract, legally binding in a court of law, between two people who are preparing for their marriage.  It sets-forth to outline each person’s assets and how they will be distributed should divorce occur.

Although prenuptial agreements are a hard subject to talk about with your soon-to-be significant other, after all, most of us don’t think of divorce when we are planning our wedding, but yet the reality is that many marriages end in divorce, the need to protect your assets and prepare for every situation is your right.

Prenuptial agreements essentially supersede many of the default marital laws that would otherwise apply in the event of a divorce, such as the laws that govern the division of property, i.e., retirement benefits, savings and the right to seek spousal support.

Benefits of a Prenuptial Agreement

Prenuptial Agreement has many benefits some of which are as follows:

  • Save money. Divorce can be expensive and having a prenuptial agreement in place before your marriage would reduce the need for litigation.
  • Protects your separate property. Separate property is important to protect as most often this will become assets of your estate for your heirs.
  • Separates Debt. You are able to define the liabilities of what is yours and what is your spouse’s.
  • Avoid the state dividing your property. There can be no interpretation on the meaning of what is considered community and separate property if you set it forth in a prenuptial agreement. There would be nothing for a judge to divide as you would have set the division of your assets and debts in your prenuptial agreement.
  • Protect your business. You can designate your business as separate property in a prenuptial agreement.
  • No need for litigation. Prenuptial agreements are far less costly then litigation proceedings.
